These Terms of Service ("Terms") are an agreement between you and DOTSNEWCO Inc., a Delaware corporation ("yolo", "we", "us", "our"). They govern your use of the yolo website at justyolo.it, its apps and related pages, and the software and services described in section 2 (together, the "Interface").

Please read these Terms carefully. They include a summary of risks (section 11), limits on our liability (section 15), and an agreement to resolve disputes through individual arbitration rather than in court or class actions (section 17). By creating an account, connecting a wallet, or using the Interface, you accept these Terms and our Privacy Policy. If you do not agree, do not use the Interface.

1. Key terms

In these Terms:

  • "Polymarket" means the prediction-market exchange operated by Polymarket and its affiliates, including its order book, smart contracts, APIs and account infrastructure, and "Polymarket Terms" means the terms, rules and policies Polymarket applies to its users and markets.
  • "Market" means an outcome market listed on Polymarket, and a "Position" means outcome shares you hold in a Market.
  • "Ticket" means a sequence of two or more Markets that you select or copy in the Interface, together with the settings you choose for it.
  • "Leg" means one Market within a Ticket.
  • "Polymarket Account" means the Polymarket account (including any Polymarket deposit wallet or other smart account) that holds your funds and Positions and is controlled by your Wallet.
  • "Wallet" means the blockchain wallet that owns your Polymarket Account: either an embedded wallet created for you through Privy, or your own external wallet that you connect.
  • "Trading Key" means the limited trading permission described in section 6.
  • "Third-Party Services" means services we do not operate, including Polymarket, Privy, payment and on-ramp providers, bridges, blockchain networks, RPC providers, and social platforms.
  • "Voucher" means a Promotion that pays for one Ticket, up to the amount shown on the Voucher, including the fees to start it.
  • "Ticket Money" means Promotion funds we have sent for a Voucher that have not yet been used to start a Ticket, or that came back from a Ticket you cashed out before its first Leg was decided, up to the amount the Voucher or Ticket Money paid for that first Leg.

2. What yolo is, and what it is not

yolo is software. The Interface is a user interface and automation tool that connects to Polymarket through Polymarket's publicly available APIs. It lets you:

  1. browse Markets listed on Polymarket and data about them;
  2. select Markets and arrange them in a sequence as a Ticket;
  3. instruct the Interface to place orders in your own Polymarket Account, on Polymarket, according to the settings you choose, including automatically buying the next Leg after a Leg reaches the price you set; and
  4. share Tickets with others and copy Tickets others have shared.

All trading happens on Polymarket. Every order the Interface places is an order on Polymarket, for your own Polymarket Account, subject to the Polymarket Terms. Polymarket lists the Markets, operates the order book, matches orders, sets and charges its own fees, holds the market rules, and decides how every Market resolves. Your counterparty is another Polymarket user, never yolo.

What yolo does not do. yolo does not:

  • create, list, operate or resolve any Market, set any price, or act as a counterparty to any trade;
  • accept, hold, pool or control your funds or Positions at any time, or have the ability to withdraw them;
  • act as an exchange, broker, dealer, introducing broker, futures commission merchant, investment adviser, commodity trading advisor, portfolio manager, custodian, bank, payment institution or money transmitter;
  • operate a betting, wagering, gaming or gambling service, or act as a bookmaker; or
  • give investment, financial, trading, legal or tax advice or recommendations.

Members of our team may use the Interface and trade on Polymarket in their personal capacity, on the same terms as other users. They have no access to other users' orders before they are placed and do not trade against users through yolo.

We provide the Interface "as a tool". You decide which Markets to use, in what order, with what amount and settings, and whether to start, copy, change or cash out a Ticket.

3. Who may use yolo

You may use the Interface only if all of the following are true:

  1. you are at least 21 years old, and at least the age of majority and the minimum legal age for using prediction markets where you live, if either is higher;
  2. you are not a resident, citizen or national of, located in, or organised in, the United States or any of its territories, or any Restricted Territory (below);
  3. you are not, and are not acting for, a person on any sanctions list maintained by the United States (including OFAC), the United Nations, the European Union, the United Kingdom or Switzerland, and not owned or controlled by such a person;
  4. you are permitted to use Polymarket under the Polymarket Terms;
  5. using the Interface and trading on Polymarket is lawful for you where you are; you are solely responsible for checking this; and
  6. you use the Interface only for yourself, with your own funds, and not on behalf of any other person or as a business.

Restricted Territories. "Restricted Territories" means (i) any country or region subject to comprehensive sanctions, currently Cuba, Iran, North Korea, Syria, and the Crimea, Donetsk, Luhansk and Sevastopol regions; and (ii) every country or region where Polymarket blocks or restricts access, as Polymarket publishes from time to time. We may also restrict access from other countries or regions at any time, with or without notice.

Location. We use your connection data to determine where you are and may restrict features accordingly. In some Restricted Territories we may still let you cash out, withdraw, or turn off autotrading so that you can access your own funds, but you must not start or copy Tickets there. You must not use a VPN, proxy or any other method to hide or misrepresent your location, age or identity. If you do, or we reasonably believe you have, we may suspend or close your access immediately.

Invitation. While the Interface is in alpha or beta, access may require an invitation code. Invitation codes are personal and may not be sold or transferred.

4. Third-party services

The Interface depends on Third-Party Services that we do not own, operate or control. Your use of each is governed by that provider's own terms and privacy policy, which you must accept where they require it. In particular:

  • Polymarket provides the Markets, order book, Polymarket Accounts, deposit wallets, bridges, relayer and market resolution. yolo is not affiliated with, endorsed by or acting for Polymarket, and we are not responsible for Polymarket's acts, omissions, availability, prices, fees, rules or resolutions.
  • Privy provides sign-in (email, Google and passkey) and, for users who do not connect their own wallet, an embedded Wallet. Privy, not yolo, generates and secures the keys of embedded wallets using its own infrastructure; yolo never receives or stores your Wallet's private keys. Your relationship with Privy for those services is governed by Privy's terms.
  • Payment, on-ramp and off-ramp providers (for example the card checkout partner offered through Privy, or MoonPay for bank withdrawals) process card, bank and crypto conversions, run their own identity and compliance checks, set their own fees, limits and timelines, and are solely responsible for those transactions.
  • Blockchain networks, bridges and RPC providers process transactions under their own rules. Blockchain transactions are public and irreversible.

We may add, remove or replace Third-Party Services at any time. We are not liable for any loss caused by a Third-Party Service, including outages, errors, insolvency, security incidents, changes to their APIs or rules, or their decisions about your account.

5. Your account, Wallet and Polymarket Account

5.1 Signing in

You can create your account with an email code, a Google account, or an external wallet you connect. Once you have an account you can add a passkey to sign in faster; a passkey cannot be used to create one. You are responsible for keeping your sign-in methods, devices and wallet credentials secure, and for everything done through your account. One person may hold only one account.

5.2 Two ways to hold your Wallet

  • Embedded Wallet. If you create your account with email or Google, a Wallet is created for you through Privy. Privy secures its keys; yolo cannot access them.
  • Your own wallet. If you connect your own external wallet (for example MetaMask, Rabby or Coinbase Wallet), that wallet owns your Polymarket Account, you alone hold its keys, and neither yolo nor Privy has custody of it. You are responsible for that wallet's security and recovery.

5.3 Your Polymarket Account

The Interface can (a) ask Polymarket to create a new Polymarket Account owned by your Wallet, or (b) link a Polymarket Account your Wallet already owns. Where your existing account is of a type that cannot yet be used with third-party interfaces, the Interface may offer to open a new Polymarket Account owned by the same Wallet and, only if you approve each transaction, move cash into it. Your funds and Positions always remain in a Polymarket Account controlled by your Wallet.

Each action that requires your Wallet's signature is explained in the Interface before you approve it. You are responsible for reviewing what you approve.

5.4 Funding and withdrawals

You may add funds by sending supported stablecoins to your Polymarket Account or through a payment provider offered in the Interface, and withdraw cash through supported bridges or providers. Supported assets, networks, minimums and estimated network fees are shown in the Interface. Assets sent to the wrong address or network may be lost permanently. Cash held in open Tickets must be cashed out before it can be withdrawn.

6. The Trading Key and autotrading

To carry out your Tickets without asking you to approve every order, the Interface asks your Wallet to grant a Trading Key: a limited permission, registered with Polymarket, that allows yolo's software to submit your buy and sell orders for your Polymarket Account.

  • Trading only. The Trading Key allows Yolo to place and cancel your orders. It cannot withdraw or transfer your funds or Positions out of your Polymarket Account.
  • Your limits. When you grant it you choose a spending limit, and the permission lasts for the period shown in the Interface (currently up to 180 days, the maximum Polymarket allows). yolo's software enforces your spending limit. We will remind you before the permission expires; after it expires, autotrading stops until you grant a new Trading Key.
  • Other apps. For embedded Wallets, granting a yolo Trading Key may replace trading permissions previously given to other applications on the same Polymarket Account. The Interface tells you when this applies.
  • Turning it off. You can turn autotrading off at any time, from any location, in your account settings. This revokes the Trading Key; Tickets already open will then wait for you to act instead of continuing automatically.
  • How we protect it. The Trading Key's private half is generated and stored encrypted on our servers and used only to submit orders that follow your Ticket settings.

No discretion. You authorise yolo's software to place orders under your Trading Key only as your Ticket settings and these Terms describe. The process is automated: yolo does not choose Markets, amounts or timing for you, does not exercise judgment over your account, and does not manually intervene in, override or reverse orders, except to stop activity where required by law, these Terms or a technical safeguard.

7. How Tickets work

Building a Ticket. A Ticket contains two or more Legs, ordered so that each Leg settles no earlier than the one before it. You choose the amount for the first Leg, within the minimum and maximum shown in the Interface. Only the first Leg is bought when you start a Ticket; each later Leg is bought when the previous one reaches your roll price, at the price available at that moment.

Before you start, the Interface shows the Legs, current prices for the Legs, an estimated multiplier, the fees, and the total you will pay. The estimated multiplier is a calculation from current prices; it is not a promise of any return, and the actual result will differ.

Ticket rules. How a Ticket moves from one Leg to the next, and how it ends, is set by the rules the Interface shows when you start or change the Ticket (the "Ticket Rules"). Ticket Rules can include, for example: a roll price at which a Leg is sold and the next Leg bought; how much of the proceeds roll on; whether a final Leg is sold at the roll price or held until its Market resolves; whether a Leg whose price falls is held until resolution or sold; and any automatic sell levels you set, such as a take-profit or loss-limit percentage. You agree that the Interface will act automatically under the Ticket Rules that apply to your Ticket.

What selling early means. Where Ticket Rules sell a Leg before its Market resolves, including the final Leg, you receive less per share than the $1.00 a winning share pays at resolution, and fees apply to that sale as well as to each purchase. Where Ticket Rules hold a Leg until resolution, its value can fall to zero before then.

Automatic sell levels. If you set a take-profit or loss-limit level, the Interface will try to sell when the price reaches it, but in fast or thin markets the sale may happen at a worse price, partly, or not at all. A level is not a guarantee of any price.

Timed sells. Some Ticket Rules sell a Position at a set time rather than at a set price (a five-minute ride sells five minutes after its purchase). A timed sell is placed at the best price available at that time, with no minimum, and in fast or thin markets may fill at a worse price than shown moments before, partly, or late. If the Market closes before the time (for example, a match ends), the Position is held until the Market resolves.

Changes to Ticket Rules. We may change Ticket Rules and their defaults at any time. Changes apply to Tickets started after the change. Where a change affects Tickets already open, we will show it in the Interface, and you can cash out instead of continuing under the new rule.

Order limits and failures. Orders are submitted at market prices within protective limits shown in or applied by the Interface. An order may fill at a different price, partly, or not at all, for example if prices move, liquidity is thin, Polymarket or a network is unavailable, a Market closes or is paused, or your Trading Key or limits do not allow it. We do not guarantee that any order fills, fills at a particular price, or fills in time for the next Leg.

Cashing out. You can cash out a Ticket by selling its current Position at the price available at that time, except while a Leg is settling. Cashing out ends the Ticket.

Resolution. Polymarket alone determines how and when each Market resolves, including disputes, delays, clarifications, cancellations and invalid or 50/50 outcomes. The Interface follows Polymarket's resolution and payout.

Simulations. Where no valid Trading Key is in place, the Interface may show a simulated Ticket using live prices but placing no orders. Simulations are labelled and have no financial effect.

8. Information and tickets shown in the Interface

The Interface shows Market data, prices, statistics, rankings and estimates drawn from Polymarket and other public sources, including live scores, asset prices and other reference data from third-party providers, and it may display Tickets that are generated automatically by software from public Market data using objective criteria (for example timing, liquidity, price range or estimated multiplier) ("Generated Tickets"), as well as Tickets made public by other users ("Community Tickets").

  • Generated Tickets are labelled as such. They are produced by fixed rules applied to public data, are provided for information and convenience only, and are not recommendations, predictions, tips or an assessment of any outcome's likelihood.
  • Community Tickets, profiles and leaderboards reflect what other users chose. Their creators are not our employees, agents or advisers, and past results say nothing about future results.
  • All information is provided "as is" and may be delayed, incomplete or wrong. You should not rely on it as the basis for any decision, and you are solely responsible for the Tickets you start or copy.

9. Fees

Two kinds of fees can apply to every order the Interface places:

  • Polymarket fee. Polymarket may charge its own spreads and fee for trading, market making or to pass on to other market makers, which varies by Market and price and is set and collected by Polymarket under the Polymarket Terms.
  • yolo fee. We may charge a fee on each order the Interface places, collected through Polymarket's builder programme, at the rate shown in the Interface before you confirm. We may introduce, change or remove the yolo fee, or set different rates for different features or Promotions, up to the maximum Polymarket permits.

Because a Ticket places new orders each time it rolls or is cashed out, these fees can apply to each Leg's purchase and each sale, not only once. The Interface shows the fees for your first order before you start. We may change the yolo fee; any change applies only to orders placed after it takes effect and is shown in the Interface. Payment providers, bridges and blockchain networks charge their own fees.

10. Promotions, rewards and sharing

10.1 Promotions

We may offer promotions, such as Vouchers, trial amounts, invitation rewards or competitions ("Promotions"). We may deliver a Promotion by sending funds directly to your Wallet or Polymarket Account. Each Promotion is governed by these Terms and by the specific rules we publish for it, which prevail if they conflict. Unless those rules say otherwise: no purchase is necessary to receive a Promotion; Promotions are personal, non-transferable and have no cash value; promotional funds may be usable only to start Tickets and may not be withdrawable; any proceeds above the promotional amount may be subject to conditions such as completing feedback; Promotions are void where prohibited; and we may limit, change, suspend or end any Promotion, and cancel benefits obtained through multiple accounts, false information, location masking or other abuse. Vouchers and Ticket Money are Promotions; section 10.2 sets out their rules.

10.2 Vouchers and Ticket Money

Getting a Voucher. We may give you a code that adds one or more Vouchers to your account. A code may be limited to one email address, and it expires if it isn't used within 30 days. Each Voucher expires 30 days after the code is used. Unused Vouchers end when they expire, and they have no cash value.

Using a Voucher. A Voucher pays for one Ticket of up to $1, plus the fees to start it, up to 110% of the Voucher amount. You choose to use a Voucher at checkout; we never use one for you. To use a Voucher, we send the funds for that Ticket to your Wallet or Polymarket Account, as described in section 10.1.

Ticket Money. Any part of a Voucher that isn't spent on the Ticket, and any amount that comes back from a Ticket you cash out before its first Leg is decided, up to what the Voucher or Ticket Money paid for that Leg, is Ticket Money. Anything above that is held earnings (see below). Ticket Money can only be used to start Tickets, when you choose to. It can't be withdrawn, sent to another account, or used for anything else, and it has no cash value. The Interface shows Ticket Money as part of your cash balance, and says how much of that balance is Ticket Money where it matters, such as when you withdraw.

When it becomes yours. Once the first Leg of a Ticket started with a Voucher or Ticket Money is decided as a win, everything that Ticket later returns to you is yours. Until you complete our feedback form (see below), those returns are held: they show in your account as held earnings and can't be withdrawn or used to start Tickets. Once the form is complete, they are yours to keep, use or withdraw like any other cash, subject to section 5.4. If the first Leg loses, the Ticket ends and nothing comes back.

Feedback form. Once each Voucher from your first code has started a Ticket, or 30 days after you used that code if sooner, we ask you to complete a short feedback form. Until you do, you can't use Vouchers or Ticket Money, and held earnings stay held. Completing it releases your held earnings and may give you one more Voucher. We give at most one such Voucher per account. Your answers are Feedback under section 13.

Top-up match. After you complete the feedback form and the Voucher it gave you has started a Ticket (or has expired), we may ask you one more short question. Once you answer it, we may offer you a top-up match for 30 days. For each whole dollar you add to your account during those 30 days, we add one $1 Voucher, up to 5 Vouchers in total. What you add is counted together over the 30 days and rounded down to whole dollars, so adding $3.50 gives you 3 Vouchers. Only funds you add through the Interface's add funds options after we show you the offer count; Vouchers, Ticket Money and anything else we send you do not. Each account can receive the match once. Matched Vouchers follow the rest of this section 10.2 and expire 30 days after we add them. Because you have already completed the feedback form, anything a Ticket started with a matched Voucher wins is yours under "When it becomes yours". If our promotion funds are low, we may add matched Vouchers later than usual, once they are topped up.

Limits. Vouchers are personal and may not be sold or transferred. We limit how many wrong codes can be tried from one account or network in a day. Each person may benefit from Vouchers through one account only (section 5.1).

Changes and misuse. We may pause, change or end Vouchers at any time, and cancel unused Vouchers and Ticket Money, in line with section 10.1. If we reasonably believe you have misused Vouchers or Ticket Money, including through more than one account, or by moving Ticket Money or held earnings out of yolo by any means other than the Interface, we may cancel your Vouchers and Ticket Money, withhold any held earnings, refuse future Promotions and take action under section 12.

Closing your account. If you close your account, any unused Vouchers end at once. Ticket Money, held earnings and Rewards not yet paid to you are not paid out.

10.3 Sharing and copying

Tickets you start may be shown publicly with your username unless you change your visibility settings, and you may choose to hide amounts. Other users may copy your public Tickets; a copy is a separate Ticket bought by that user at the prices available at the time.

10.4 Rewards programmes

We may offer programmes that reward users who create, share or refer Tickets or new users, for example by sharing part of the yolo fee earned on resulting activity ("Rewards"). The eligibility, amount, calculation, timing and method of any Rewards are set out in programme rules published in the Interface, and may depend on criteria such as the number of copies or referred users. Rewards are not wages or compensation for services, accrue only as stated in those rules, may be withheld or reversed for fraud, self-referral, multiple accounts, breach of these Terms or legal requirements, and may be changed or discontinued at any time. You are responsible for any taxes on Rewards. If you close your account, Rewards not yet paid to you are forfeited, and you earn no further Rewards from copies of your Tickets.

10.5 If you promote yolo

If you share, recommend or refer yolo or any Ticket publicly, and especially if you receive or may receive Rewards, you must follow the Promotion Guidelines in Schedule 1. You are responsible for what you say. You are not our agent or representative and may not make statements on our behalf.

11. Risks you accept

Only use funds you can afford to lose entirely. By using the Interface you understand and accept that:

  1. You can lose the full amount. Most Tickets do not land. If any Leg's outcome does not occur, the amount in that Leg is lost. Tickets with more Legs or lower-priced Legs are less likely to land.
  2. Prices move fast. Markets, especially short-duration Markets, can change within seconds. Orders, rolls and cash-outs can execute at worse prices than shown, partly, late or not at all.
  3. Selling early and fees reduce returns. Rolls happen below the $1.00 paid at resolution, and fees apply to each order.
  4. Automation and software can fail. The Interface is early-stage software and may contain errors. Bugs, outages, latency, attacks or changes affecting yolo, Polymarket, Privy, providers, networks or oracles can prevent or delay an action when it matters.
  5. Third parties control key functions, including Market listing and resolution, wallets and payments, and may restrict your account.
  6. Digital-asset risk. Balances are held in stablecoins or tokens on blockchains, whose value, availability and convertibility depend on third parties and may be affected by de-pegging, smart-contract failure or network problems.
  7. Legal and regulatory risk. Laws on prediction markets and digital assets vary and change. A change may stop you from using yolo or Polymarket, or block access from your location.
  8. Taxes are your responsibility.

If you feel your use is becoming a problem, stop, turn off autotrading, and seek help from a local support service.

12. Rules of conduct

You must not:

  • use the Interface where it is not permitted, or misrepresent your location, age or identity;
  • create or use more than one account, use another person's account, or let anyone else use yours;
  • use the Interface for another person's funds, as a business, or to provide services to others, without our written consent;
  • trade on non-public information about a Market's outcome, attempt to influence an outcome, or manipulate prices;
  • abuse Promotions, Rewards or invitation codes, including through self-referral or coordinated accounts;
  • use bots, scrapers or automated means to access the Interface (other than the Interface's own autotrading), or probe, overload, reverse-engineer or attack our systems;
  • use the Interface for money laundering, terrorist financing, fraud, sanctions evasion or any unlawful purpose;
  • post usernames, images or content that is unlawful, misleading, abusive, infringing, or that promotes the Interface to minors.

We may suspend, restrict or close your access, revoke your Trading Key, cancel Promotions and Rewards, and refuse to process actions if we reasonably believe you have breached these Terms or the law, if required by law or a regulator, or to protect users or yolo. Where lawful, we will tell you why. Closing your yolo access does not give us control over your Wallet or Polymarket Account.

13. Communications and notifications

Service messages. We will send you messages needed to provide the Interface, such as sign-in codes, security alerts, Ticket activity, Promotion updates you joined, and changes to these Terms. These are part of the service and cannot be switched off while you have an account.

Marketing and notifications are your choice. With your consent, given separately (for example by ticking an unticked box at sign-up or enabling a setting), we may send you marketing emails about yolo and related products, push notifications, and messages through channels such as Telegram. You can withdraw consent at any time through your account settings or the unsubscribe link in any message, without affecting your access. Other notifications in your yolo inbox, such as copies, follows and news from yolo, can be turned off in your account settings. How we use your contact details is described in the Privacy Policy.

Feedback. If you send us ideas or feedback, you allow us to use them freely without any obligation to you. Completing a feedback form may release held earnings or give you a Voucher (section 10.2). That is a Promotion, not payment for your Feedback.

14. Intellectual property and your content

We and our licensors own the Interface, including its software, design, text, logos and the "yolo" name. We grant you a personal, revocable, non-transferable licence to use the Interface under these Terms. You keep ownership of content you submit, such as your username, avatar and public Tickets, and grant us a worldwide, royalty-free licence to host, display, reproduce and share it (including in share cards and marketing of the relevant Ticket) for operating and promoting the Interface. You confirm you have the rights to anything you submit.

15. Disclaimers, assumption of risk and limitation of liability

Early-stage software, used at your own risk. The Interface is experimental, alpha-stage software that is being built and changed rapidly. It may not work as described, may contain errors, and may stop working at any time. You use it entirely at your own risk and choose to do so knowing you may lose some or all of the funds you use with it.

No warranties. The Interface, all information in it, and all Promotions are provided "as is" and "as available", with all faults. To the fullest extent permitted by law, we disclaim all warranties and conditions of any kind, express, implied or statutory, including of merchantability, fitness for a particular purpose, title, accuracy, availability, security and non-infringement, and any warranty arising from course of dealing or usage.

No duties beyond these Terms. We do not owe you any fiduciary, advisory or other duty beyond those expressly set out in these Terms. We have no duty to monitor your Tickets, to warn you about prices or Market events, or to act on your behalf except as your Ticket Rules direct.

Losses we are not responsible for. To the fullest extent permitted by law, we are not liable for any loss or damage arising from or relating to: Market outcomes, resolutions or cancellations; price movements; the execution, partial execution, delay or failure of any order, roll or cash-out; the operation of Ticket Rules or automation, including errors in them; bugs, outages, latency or security incidents; Third-Party Services, including Polymarket and Privy; blockchains, bridges, oracles or stablecoins; your Wallet, devices or credentials; unauthorised access to your account; Promotions, Vouchers and Ticket Money or Rewards; information or Generated Tickets shown in the Interface; content or Tickets shared by other users; changes to or discontinuation of the Interface; or any event beyond our reasonable control.

Type of damages. To the fullest extent permitted by law, we are not liable for any direct, indirect, incidental, special, consequential, exemplary or punitive damages, or for any loss of profits, revenue, funds, positions, data, goodwill or opportunity, however caused and even if we were told they were possible.

Cap. To the fullest extent permitted by law, our total liability for all claims of any kind relating to the Interface, these Terms or your use of yolo, together, is limited to the greater of (a) the yolo fees you actually paid in the three months before the event giving rise to the claim and (b) US$50.

Promotional funds. For anything involving Vouchers, Ticket Money or other promotional funds, our only obligation is to provide the Promotion as its rules describe; we are not liable for any loss of promotional funds or anything they buy.

Your only remedy. If you are unhappy with the Interface, your sole remedy is to stop using it, turn off autotrading and close your account. We may choose, entirely at our discretion, to fix an error or make a goodwill payment, but doing so does not create any obligation or admit any liability.

What we cannot exclude. Some laws do not allow certain warranties or liabilities to be excluded or limited, such as liability for fraud, gross negligence, wilful misconduct, or death or personal injury caused by negligence, or rights you have as a consumer that cannot be waived. Nothing in these Terms excludes or limits those, and in those places our liability is limited to the smallest extent the law allows. Each limitation in this section applies separately and survives if another part is found unenforceable.

Indemnity. You will indemnify, defend and hold harmless yolo, its affiliates and their officers, directors, employees and agents from all claims, losses, liabilities, costs and reasonable legal fees arising from your use of the Interface, your breach of these Terms, your violation of any law or third-party right, or content you share or statements you make in promoting yolo.

16. Changes, suspension and termination

The Interface is under active development and may change significantly, including features, supported Markets, limits and fees. We may modify, suspend or discontinue all or part of it at any time. We may update these Terms; if a change is material we will give reasonable notice in the Interface or by email before it takes effect, and continued use after that means you accept the updated Terms. You may stop using the Interface and close your account at any time. Any unused Vouchers end, and Ticket Money, held earnings and Rewards not yet paid to you are not paid out (sections 10.2 and 10.4). Sections 2, 4, 8, 9, 10, 11 and 14 to 18 survive termination.

17. Disputes and governing law

Governing law. These Terms are governed by the laws of the State of Delaware, United States, and applicable US federal law, including the Federal Arbitration Act, without regard to conflict-of-law rules.

Informal resolution first. Before starting any claim, you agree to send us a written description of the dispute through our contact form and to try to resolve it informally for at least 60 days.

Arbitration. Any unresolved dispute arising out of or relating to these Terms or the Interface will be resolved by final and binding arbitration administered by JAMS under its rules then in effect (its International Arbitration Rules where you live outside the United States), by a single arbitrator, in English, seated in Wilmington, Delaware. Hearings will be held by video or decided on written submissions unless the arbitrator decides otherwise. Either party may bring an individual claim in small-claims court instead where eligible.

Mass filings. If 25 or more similar claims are brought by or with the help of the same law firm or organisation, they will be administered in batches of up to 25, with the remaining claims paused until each batch is decided, and fees will be assessed per batch, to the extent JAMS rules allow.

Time limit. You must bring any claim within 30 days after you first knew, or should have known, of the facts giving rise to it, or the claim is permanently barred. If the law where you live does not allow a period that short, the claim must be brought within the shortest period that law allows.

No class actions. Disputes will be resolved only on an individual basis. You waive any right to bring or participate in a class, collective or representative action or arbitration.

Opt-out. You may opt out of this arbitration agreement by sending us a message through our contact form, or by emailing notices@justyolo.it if you can't sign in, within 30 days of first accepting these Terms.

Your local rights. If you are a consumer and the law of the country where you live gives you rights or protections that cannot be waived by contract, including the right to bring proceedings in your local courts, nothing in these Terms takes those away.

18. General

These Terms, the Privacy Policy, and any Promotion or programme rules form the entire agreement between you and us about the Interface. If any provision is unenforceable, the rest remains in effect. Our failure to enforce a provision is not a waiver. You may not assign these Terms; we may assign them to an affiliate or successor. If we provide a translation, the English version prevails.

Schedule 1: Promotion Guidelines

These guidelines apply to anyone who shares, recommends or refers yolo or a Ticket, including creators and anyone receiving Rewards. They form part of the Terms.

You must

  • Disclose your interest. If you may earn Rewards or have any other incentive, say so clearly and up front in each post, for example "I earn if you copy this" or "#ad", in a way that is visible without clicking "more".
  • Be accurate. Describe yolo as a tool for creating and managing Tickets on Polymarket, and Tickets as positions in Polymarket markets. Show estimated multipliers as estimates.
  • Mention the risk. Make clear that a Ticket can lose the full amount, and include "21+" in promotional posts.
  • Follow the platform's rules of wherever you post, including its policies on financial, crypto and gambling-related content and paid promotion, and all applicable advertising and consumer-protection laws.

You must not

  • promise, guarantee or imply profits, "sure things", risk-free results or that anyone will make money;
  • describe yolo as a sportsbook, casino or betting site, or use "odds", "bet" or "wager" to describe yolo or its Tickets, or present yourself as an expert adviser giving recommendations;
  • target or address people under 21, or people in the United States or any Restricted Territory, including through location-targeted ads or communities based there;
  • tell people how to bypass location restrictions, use VPNs or create multiple accounts;
  • imply that yolo, Polymarket or any partner endorses you or your Tickets, or use our logos except as we provide them;
  • run paid ads using the yolo name, or bid on yolo brand keywords, without our written approval;
  • send spam or unsolicited messages, or post in communities that prohibit promotion.

We may ask you to edit or remove content, and may withhold or reverse Rewards and suspend access for breaches.
